Comal County DA’s Office Resolves 204 Felony and Misdemeanor Cases in August

The Comal County Criminal District Attorney’s (DA) office tried, pled or oversaw the punishment of 204 felony and misdemeanor cases in August.

Cases were heard in both county district courts and in the county courts-of-law, the DA’s office said on social media.

Among those convicted were:

Wesley Barboza, 43, of New Braunfels

Pled guilty to Possession of a Controlled Substance PG 1 > 1 Gram < 4 Grams (methamphetamine) and Tampering with Physical Evidence.

He was sentenced to 45 years confinement in the TDCJ by Judge Tracie Wright-Reneau of the 207th District Court.

Barboza also pled guilty to Forgery > $2,500 < $30,000 and two counts of Fraudulent Use or Possession of Identifying Information and was sentenced to 20 years in prison.

These sentences will run concurrently.

Barboza was enhanced to a Habitual Offender due to his prior criminal history, including felony convictions of Prohibited Item in a Correctional Facility (cell phone), Assault on a Public Servant, Possession of a Controlled Substance and Receiving Stolen Property.

Brian Motacek, 48, of Spring Branch

Pled guilty to Possession of a Controlled Substance PG 1 > 1 Gram < 4 Grams (methamphetamine) and Tampering with Physical Evidence and was sentenced to 35 years confinement in TDCJ by Judge Bruce Boyer of the 22nd District Court.

Motacek has an extensive criminal history, including out-of-state felony convictions of Aggravated Assault by Domestic Violence, Theft, Forgery, and Burglary.

Bradley Knight, 32, of New Braunfels

Pled guilty to Accident Involving Death – a second-degree felony, with his punishment to be determined by the court without the possibility of community supervision.

The range of punishment for this case was two to 20 years in the TDCJ. Judge Stephanie Bascon of the 466th District presided over the punishment hearing and sentenced Knight to 15 years of confinement.

During the punishment hearing, two eyewitnesses gave first-hand accounts of what they saw on the date of the incident and discussed how it continues to impact their daily lives.

The judge also heard testimony from numerous family members and close friends of the victim.

Tyson Miller, 48, of Boerne

Pled guilty to Possession of a Controlled Substance PG 1 > 1 Gram < 4 Grams (methamphetamine) and was sentenced to 36 years confinement in TDCJ by Judge Bruce Boyer of the 22nd District Court.

Miller has a lengthy criminal record that includes prior felony convictions for drug possession, theft, forgery, and a federal offense of possession of stolen mail.

In addition, Miller is a confirmed member of the Aryan Brotherhood of Texas with numerous Nazi tattoos, including a Swastika, SS lightning bolts, and a portrait of Hitler in Nazi uniform.

Jose Antonio Moreno, 43, of Marion

Pled guilty to Evading Arrest or Detention with Vehicle, Possession of a Controlled Substance PG 1 > 4 Grams < 200 Grams (methamphetamine), Possession of a Controlled Substance PG 1 > 1 Gram < 4 Grams (methamphetamine), Theft > $30,000 < $150,000, Prohibited Substance in a Correctional Facility, and Tampering with Physical Evidence.

Judge Bruce Boyer of the 22nd District Court presided over the court and sentenced Moreno to 45 years in TDCJ.

Richard Foreman, 57, of Gainesville, Florida

Pled guilty to Intoxication Assault and was sentenced to seven years confinement in TDCJ by Judge Dwight Peschel.

Augustine Valero, 27, of New Braunfels

Pled guilty to Possession with Intent to Deliver a Controlled Substance PG 1 > 4 Grams < 200 Grams (methamphetamine) and was sentenced to 17 years confinement in the TDCJ by Judge Bruce Boyer of the 22nd District Court.

Valero was enhanced to a Repeat Offender due to his prior criminal history including the felony convictions of Continuous Violence Against the Family, Assault Family Violence by Impeding Breath or Circulation with a Prior Conviction and Assault Family Violence with a Prior Conviction.

Jason Manchester, 30, of New Braunfels

Pled guilty to Possession with Intent to Deliver a Controlled Substance PG 1 > 200 Grams < 400 Grams (fentanyl), Possession of a Controlled Substance PG 1 < 1 Gram (heroin), Possession with Intent to Deliver a Controlled Substance PG 1 < 1 Gram (fentanyl), Possession with Intent to Deliver a Controlled Substance PG 3 > 400 Grams, and two counts of Possession with Intent to Deliver a Controlled Substance PG 1 > 4 Grams < 200 Grams (fentanyl).

Judge Gary Steel of the 274th District Court presided over the court and sentenced Manchester to 35 years in the TDCJ.  Judge Steel also ruled that a deadly weapon was used during the commission of the offense.

Rick Cruz, 39, of New Braunfels

Pled guilty to Possession of a Controlled Substance PG 1 > 4 Grams < 200 Grams (methamphetamine) and Tampering with Physical Evidence and was sentenced to 30 years confinement in the TDCJ  by Judge Stephanie Bascon of the 466th District Court.

Cruz was enhanced to a Habitual Offender due to his prior criminal history and is a confirmed gang member.
